Kuwait Court of Cassation principle number 635
State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The effect of the injured spouse's waiver in the offence of adultery. An exception to the general rules. Its consequence: it must be confined to the offence of adultery and the offender personally, without extension. - The two offences of intercourse with a female relative within the prohibited degrees and acceptance by a female who has attained twenty-one of intercourse with a male relative within the prohibited degrees, criminalized under Articles 189/1 and 190 of the Penal Code, differ in their legal elements from the offences of intercourse with a woman who has attained twenty-one and is not within his prohibited degrees, criminalized under Article 194 of the Penal Code, and adultery. Its consequence: waiver in respect of the latter has no effect on the former two. The challenged judgment's departure from this and its ruling that the proceedings for those two offences are inadmissible. Error in applying the law. Requires its cassation. - 175 - Penal Law 4- Indecent act
