Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 690

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court’s conviction. Is based on purposes and meanings, not words and forms. - The court’s reliance on a presumption expressly and directly indicating what it inferred from it. Not necessary for the validity of the judgment. - The judgment’s inference that the appellant committed the theft from investigations which disclosed nothing contrary to what the parties to the incident stated. Does not vitiate it. The challenge that it contradicts what is established in the papers. Incorrect.
