Kuwait Court of Cassation principle number 751

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The accused's replacement of the cheques he issued with another cheque at a later time constitutes indivisible criminal activity. Its effect. The extinguishment of criminal proceedings in respect of all of them upon issuance of the final judgment. The basis thereof. - The judgment confining its response to the plea of res judicata to the ground that it was not established that the cheques were drawn on one day for one purpose, without stating the reasons for issuing the other cheque and whether it was a replacement for the other cheques forming the subject of the proceedings, although the difference in the dates on which those cheques were drawn and the motive for issuing them does not in itself negate that their issuance all arose from a single criminal activity in respect of which criminal proceedings are extinguished upon issuance of a final judgment concerning any of them. Vitiates it by inadequate reasoning requiring its cassation.
