Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 8

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The criminal action in felonies lapses upon the passage of ten years from the day the offence occurred. - The running of that period is interrupted by any charging, investigation or trial procedure, whether in the presence of the accused or in his absence, and also by inquiries if undertaken in the presence of the accused or formally notified to him. The reason: the presumption that the action is forgotten through the passage of time without procedures being undertaken therein; once they are undertaken, it becomes present in minds and the reason for extinguishment ceases. The challenged judgment's departure from this view. An error in applying the law requiring its cassation. Example.
