Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1390

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Duress. Its nature. What vitiates consent is fear. The requirement that fear be generated by the act of an actor. Fear generated by the circumstances surrounding a person or by mere reverence is not duress. The reason for this. Mere moral influence, if not accompanied by unlawful influence, does not thereby invalidate the obligation.
