Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1421

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Assessment of the existence or absence of duress. A matter of fact. Independently determined by the judge of merits whenever he bases his judgment on sound reasons having an established basis in the papers. - The challenged judgment's conclusion that the release attributed to the appellant is evidence against him because it is valid, on the basis that threatening to cancel residency and deport him from the country does not constitute moral duress vitiating consent because these are rights accorded to the employer, and that the fear generated in the appellant arose from his own circumstances without intervention. Its subsequent disregard of the request to refer the action for evidentiary investigation. Does not vitiate it. The rationale therefor.
