State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A contract concluded by an agent in the principal’s name. Its effects accrue to the principal. If the agent does not disclose the principal’s name upon contracting, the other contracting party has the option of recourse against the agent or the principal, as that party’s interest requires. The contracting party is compelled to have recourse against the principal if that party knew or was presumed to know that the contract was concluded through representation, or was indifferent as to whether the contract was concluded with the representative or the principal.
Arabic original
