The right of the trial judge to infer whether or not a contracting party breached his obligation so as to incur contractual liability. Its condition. The inference must be reasonable and derived from elements leading to it. An example of a defective inference of the liability of a female warehouse owner for a fire therein, without examining her defence based on her performance of her contractual obligations, and without stating the nature of her breach of her obligations, with the reasons being weak and diminishing concerning the cause of the fire.
