State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The doctrine of unforeseen circumstances. Its application requires that, after the conclusion of the contract and before completion of performance of the obligation arising from it, an exceptional event of a general nature occurs which was not contemplated and could not have been foreseen when contracting, and which renders performance of the obligation onerous. - Occurrence of the unforeseen event after performance of the obligation. Leaves no room for a claim to reduce the obligation.
