A contract for which the legislature prescribes a special form. Failure thereof. Its effect. Absolute nullity. Exceptions thereto: the principle of stability of transactions, protection of third parties and a person’s not benefiting from his own fault. - The partners’ failure to put the company contract into the form required by law. They may not invoke the nullity of its incorporation contract against third parties.

العقد الذي يفرض المشرع له شكلاً خاصاً. تخلف ذلك. أثره. البطلان المطلق. الاستثناءات على ذلك: مبدأ استقرار المعاملات وحماية الغير وعدم استفادة الشخص من خطئه. - تقاعس الشركاء عن إفراغ عقد الشركة في الشكل الذي تطلبه القانون. عدم جواز تمسكهم قبل الغير ببطلان عقد تأسيسها.Original Arabic judgment citations
