English translation of the principle
Rescission of the contract extinguishes the penalty clause contained therein. The consequence thereof: the judge may assess compensation against the contracting party in default of his obligation. Example of rescission of an installment sale contract for a car for failure to comply with payment of the installments, and of the court’s assessment of the amount of compensation and its order requiring the female purchaser to pay it.
