State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The final contract, rather than the preliminary contract, is what settles the relations between the parties. It alone becomes the law governing the contracting parties from the date of its conclusion. Absence from the final sale contract of a condition requiring delivery of the immovable property vacant by a specified date and of the financial penalty resulting from breach of that condition. Its implication. The parties’ agreement to amend the preliminary sale contract by dropping it. Its effect. Non-existence of this condition from the date of registration of the sale contract.
