Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2766

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Suretyship. Its nature. The independence of the principal debt contract in its parties and subject matter. The effect thereof. The arbitration clause contained in the latter contract does not apply to the suretyship contract unless the surety accepts or ratifies it. The courts have jurisdiction to hear the dispute concerning the two contracts because they are indivisibly connected, to prevent conflicting judgments.
