Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3057

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Nullity extinguishes the contract from the time of its conclusion and removes every effect of its performance, if it has been performed. The consequence: restoring everything to its original state and each contracting party recovering what he gave, if that is feasible. If this is impossible for one of the contracting parties, the judge may oblige him to provide equivalent performance to him. An example.
