Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3071

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A void contract produces no effect. It is regarded as such from the time of its conclusion. Its performance is deemed never to have occurred. This requires: restoring the contracting parties to the position they occupied before contracting whenever this is feasible. Impossibility of doing so. The judge may order equivalent performance.
