Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3165

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Anyone who is enriched at another’s expense without lawful cause is obliged to pay that other person, within the limits of his own enrichment, what remedies that person’s loss, provided that a relationship of connection or correspondence exists between the enrichment and the impoverishment, with no lawful cause justifying the enrichment and impoverishment. - The lawful cause for enrichment and impoverishment may be a contract or a provision of law. The effect of its existence: recourse against the enriched person by an enrichment action is precluded. The reason such recourse is precluded is that the enriched person has been enriched by a legal cause.
