Payment of a debt. Its effect. Subrogation of the payer to the creditor's position. - The insurer and the third party responsible for the vehicle accident. The source of each one's obligation to compensate differs: the former's obligation arises from the insurance contract and the latter's from the harmful act. The effect thereof. Their concurrent liability for this debt, and the insurer who has paid compensation may be subrogated to the injured party's position against that third party and have recourse against him for what it paid.
