Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3939

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that a judge is not accountable for acts performed in the course of his work unless the legislature exceptionally provides for his accountability if he departs from the duties of his office and abuses it, by seeking damages against him through an action against a judge. - The Law of Procedure contains no provision permitting actions against judges. The reason for this: the legislature’s concern for judicial independence and for surrounding judges with safeguards that preserve their dignity and enable them to perform their official duties without fear of being held accountable therefor. Its implication: an action against a judge concerning his acts relating to the performance of his judicial work is inadmissible. Example.
