Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 585

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Exclusion of the applicable provisions of foreign law. Impermissible unless they are contrary to public policy or morals in Kuwait, affect the State's existence, or concern a general and fundamental interest of the community. An example of what does not fall within contravention of public policy or morals: the difference between the Jordanian compulsory insurance system, in its provisions specifying which passengers in the vehicle causing the accident are excluded from third-party status and are not covered by compulsory insurance, and the provisions of Kuwaiti law.
Arabic original
