State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Custom is a subsidiary source of law to which the judge resorts only where legislation is silent. - The Majalla of Judicial Provisions contains provisions governing the acquisition of ownership of dead land having no owner. Its consequence. The defense that there is a custom permitting sheikhs to acquire ownership of real property by unilateral will is a manifestly untenable defense, and no fault attaches to the judgment if it disregards it.
