Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1075

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The broker's remuneration is due in return for the services performed for the client. It is determined in accordance with the law, agreement, or custom; if none exists, the judge assesses it based on the effort expended and time spent in performing the work assigned. An example of a reasonable inference characterizing the relationship between the parties to the contract as a brokerage contract and negating the existence of an undisclosed partnership contract.
Arabic original
