State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The determining factor in requiring the joinder of the remaining judgment debtors in an appeal against a judgment rendered on a joint and several obligation is the true intent of the claims submitted, not the words in which those claims were framed, and that the judgment actually imposed joint and several liability. - The plaintiff basing her claims against the first defendant on the contract and against the second defendant on tortious liability. Its import. The obligation is concurrent, not joint and several, based on multiple sources of the obligation while its subject matter remains one. Its effect. There is no requirement to join the other judgment debtor in the appeal.
