Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1324

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The insurer and the third party responsible for the accident are obligated for the same debt, although the source of each differs—the first, the insurance contract; the second, the harmful act. Its effect: their concurrent liability for its discharge. Its implication: the injured party’s recourse against the insurance company to obtain compensation does not deprive him of his right of recourse against the person who caused the damage.
