Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1388

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The insurer and the third party responsible for the accident are each bound by the same debt, even though the source of each one's obligation differs. They are liable in solidum for payment of the debt and are both answerable for it. The creditor may demand the entire debt from either of them separately or from both together. The injured party's receipt from one of them of compensation that does not cover all forms of damage. Does not prevent him from seeking compensation from the other for the remaining damage that has not been redressed. This does not constitute combining two compensations. The reason: the purpose of compensation is to redress the damage in a manner commensurate with it.
