Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1553

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The seller's obligation to deliver the thing sold with the description agreed in the contract. Absence of that description. The buyer has the choice between rescinding the contract and maintaining it, with compensation in either case. This does not require that the missing attribute be material or hidden, or that the buyer knew or did not know of it, and the seller's good or bad faith is immaterial.
