Kuwait Court of Cassation principle number 1669

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The lessee’s obligation to return the leased property upon expiry of the lease in the condition in which he received it. Breach thereof. His obligation to compensate unless the destruction of or damage to the leased property was due to an external cause and without negligence on his part. - The lessee’s liability for damage to or destruction of the leased property. Presumed liability. The import thereof. The mere existence of damage to or destruction of the leased property. A presumption that it occurred through the lessee’s fault unless he proves the selection of his fault and that, in caring for and preserving it, he exercised the care of an ordinary person, unless an agreement is made to increase his liability. - The lessee’s responsibility to preserve the leased property. It extends to the acts of his subordinates and is excluded only if he proves an external cause. Proof that he exercised due care in supervising these subordinates is insufficient. The reason therefor. The nature of his obligation: an obligation to achieve an outcome, not to exercise care.
