The lessor’s obligation to enable the lessee to enjoy the leased property in a condition fit for all the enjoyment intended by the lease. - Rent is consideration for enjoyment. - The lessor. His obligation to warrant against his own physical or legal interference with the lessee. Its implication. He must refrain from any physical or legal act resulting in failure to obtain, or impairment of, the benefit intended by the lease. The reason for this. Whoever owes a warranty is precluded from interference. The challenged judgment’s contravention of this, its treating the appellant as having breached her obligations by failing to pay rent, and its ordering her eviction from the leased property despite her not enjoying it. A violation of law requiring its cassation.
