State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The donor's obligation to warrant against interference arising from his own act. Its implication is that he is precluded from defending against the donee's action by prescription or by disposing of the donee by prescription or disposing of the donated property by sale. - The donor's performance of his obligations arising from the gift contract does not entail the extinguishment of his warranty obligation, to protect the donee from the donor's personal interference. - The debtor's failure to perform the contractual obligation. A fault giving rise to his liability.
