Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1819

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The judge may - unless prohibited by a provision of law - grant the debtor a period of grace to pay his debt if its conditions are met and it does not cause serious harm to the creditor. The debtor's circumstances must warrant favoring him with this concession. This does not apply to a debtor who deliberately failed to pay or was manifestly remiss in doing so, or who is insolvent with no prospect of becoming able to pay. An example.
