Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1902

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A current account. It requires indivisibility while it is operating. Effect thereof. There is neither a creditor nor a debtor, and payment of its individual entries may not be demanded before its closure and determination of the final balance. Rationale thereof: a debt entered into it loses its separate identity and is converted into entries in that account, becoming a new debt that cannot be paid or set off separately.
