Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1908

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Cause is an essential element of every voluntary juridical act, whether a contract or a unilateral act of will, and is the first direct purpose of the act together with the impelling motive. - Absence of the cause of the act. Its effect. Absolute nullity of the act. - The cause of a release is the intention to make a gift. The existence of such an intention on the part of an injured person towards an insurance company is inconceivable. Its implication is that the injured person's release of the insurance company from the compensation due to him is without cause and absolutely void.
