Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2001

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The barring of an action for liability for an unlawful act. Upon the lapse of 3 years from the day the injured party learns of the damage and the person responsible for it, or 15 years from the date of occurrence of the unlawful act, whichever period expires first. The knowledge from which the short limitation period commences. Its intended meaning. The burden of proving knowledge in its legally intended meaning lies upon the party invoking the bar. Inferring or negating this knowledge is a factual matter within the independent competence of the court of fact, provided that its inference rests on sound reasons. Example of a sound response rejecting the defence that the action is barred by the 3-year limitation period.
