English translation of the principle

The period prescribed for barring the hearing of an action. It is interrupted by a judicial claim, even if brought before a court lacking jurisdiction, by service of the enforcement instrument, by attachment, by the creditor’s assertion of his right in bankruptcy or distribution proceedings, by assertion of his right in the course of an action, or by the debtor’s express or implied acknowledgment of the right. - The creditor’s assertion of his right in the course of an action as a ground for interruption of limitation. Its condition: it must demonstrate his assertion of his right threatened with lapse, and this is effected only by an incidental claim. Merely putting forward a defence or plea or manifesting an intention to assert the right is insufficient. - Interruption of limitation. Its grounds are exhaustively enumerated. - Ascertaining and understanding the facts of the action, assessing the existence of an impediment suspending limitation, and ascertaining the fact from which it begins. Within the authority of the court of merits. The condition for this.
