Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2546

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Extinctive prescription. Interrupted by a judicial claim embodying an unequivocal demand for the right sought to be recovered. Its effect. A statement of claim asserting a right interrupts prescription only in respect of that right and its accessories that arise with it and lapse with it. Difference between the two rights or their sources. A claim made in respect of one does not interrupt the prescription period for the other right. - 489 - Obligation - Establishment that the right in the previous action was confirmation of ownership by possession. Its difference from the subject matter of rescission of the land sale contract for breach of the obligation to transfer ownership. Rescission is not considered an accessory to the claim for confirmation of ownership because it neither arises with it nor lapses with it. Its implication. The previous action does not interrupt prescription in the latter action. Contravention thereof. An error requiring cassation of the judgment.
