Kuwait Court of Cassation principle number 2548

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An heir's acknowledgment is evidence binding only on the acknowledging party. It does not result in interruption of limitation or waiver thereof after entitlement thereto has arisen in respect of the remaining heirs if one of them waives it. - The challenged judgment's rejection of the appellant's plea that the action may not be heard, based on an acknowledgment by heirs of the first respondent's entitlement to the amount awarded, as signifying waiver by both of them and the remaining heirs of the plea that the action may not be heard. An error in the application of the law requiring its cassation.
