فرض المشرع شكلاً معيناً لعقد من العقود. مفاده. عدم صحته إلا باستيفائه. علة ذلك واتصاله بالنظام العام. تخلف. أثره. انعدام العقد ولكل ذي مصلحة التمسك ببطلانه وللمحكمة أن تقضي به من تلقاء نفسها. - ورود البيع على كافة العناصر التي يتكون منها المحل لاعتباره بيعاً لمتجر. غير لازم. تحديد العناصر التي لا غنى عنها لوجود المحل التجاري يتوقف على نوع التجارة التي يزاولها صاحب المتجر. - عقد بيع المتجر. وجوب إفراغه في محرر رسمي لدى كاتب العدل شرط لانعقاده. مخالفة ذلك. بطلان العقد. - وراجع: الوكالات العقارية في البيع. - 523 - بيع تلاقي الإيجاب والقبول:Original Arabic judgment citations
