State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A final adjudication. It acquires the force of res judicata only in respect of a dispute that arose between the litigants and was decided by the court expressly or implicitly. Its implication. Failure to register a judgment declaring the validity and enforceability of a sale contract to transfer ownership to the purchaser. Has no effect on its binding force between its parties or on preventing them from raising in any subsequent action what was previously necessarily decided expressly or by inevitable implication, even with new legal or factual evidence.
Arabic original
