An action for the validity and enforceability of a sale contract. Its purpose. Specific performance of the seller’s obligations and obtaining a judgment whose registration takes the place of the contract in transferring ownership. Its effect. The transfer of ownership to the purchaser and registration of the judgment rendered therein must be possible. Contravention thereof. An error requiring cassation of the judgment. An example concerning the sale of expropriated real property.

دعوى صحة ونفاذ عقد البيع. المقصود بها. تنفيذ التزامات البائع تنفيذاً عينياً والحصول على حكم يقوم تسجيله مقام العقد في نقل الملكية. أثره. وجوب أن يكون انتقال الملكية إلى المشتري وتسجيل الحكم الذي يصدر فيها ممكنين. مخالفة ذلك. خطأ يُوجب تمييز الحكم. مثال لبيع عقار نزعت ملكيته.Original Arabic judgment citations
