Kuwait Court of Cassation principle number 296

The heirs' right to a pension. An obligation owed by the Social Insurance Institution whose source is the law, except for the exceptional pension, whose source is the harmful act, whereas the basis of compensation is fault. It necessarily follows that the minors' entitlement to their father's pension does not diminish the amount of compensation for the material damage they suffered because of the death of the person from whom they inherited.
