Sale of undivided shares in land for which no subdivision decision has been issued. Absolutely void. Article 1 of Law 92 of 1976. The court may rule on this of its own motion. This prohibition applies to every sale whose subject matter is an undivided share in land for which no subdivision decision has been issued. Contravention thereof. Its effect. Nonexistence of the contract because the subject matter of the obligation conflicts with a provision relating to public order, and it therefore cannot be ratified. The consequence is that issuance of a subsequent subdivision decision does not validate the contract. Basis thereof. Formal sale:

بيع حصص شائعة في أرض لم يصدر بها قرار بالتقسيم. باطل بطلاناً مطلقاً. م ١ ق ٩٢ لسنة ١٩٧٦. للمحكمة أن تقضي به من تلقاء نفسها. سريان هذا الحظر على كل بيع محله حصة شائعة في أرض لم يصدر بها قرار بالتقسيم. مخالفة ذلك. أثره. انعدام العقد لتعارض محل الالتزام مع نص متعلق بالنظام العام فلا تلحقه إجازة. مؤدى ذلك أن صدور قرار لاحق بالتقسيم لا يصحح العقد. أساس ذلك. البيع الرسمي:Original Arabic judgment citations
