Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3211

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The leasehold right arising from a lease contract. A personal right. Its distinction from usufruct, which is a right in rem derived from ownership and attaches directly to the thing concerned, encompassing the power to use and exploit it without intervention by its owner. It may not be equated with the lessee's right, which is a movable right even if the subject of the lease is immovable property, and even if the lessee erects a building on the property, because his right over the building is destined to expire upon termination of the lease contract and therefore does not confer upon him a right in rem, however long its duration. Its effect. No scope for applying the provisions on ownership in common to the leased property. The reason therefor. Their application is restricted to holders of rights in rem in common.
