Kuwait Court of Cassation principle number 3691
State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The relationship of litigants with their agents. The court may not address it unless the person concerned denies his agent's authority. No person other than the principal may object that the procedural act undertaken by the agent falls outside the limits of his authority. The reason for this. An example concerning the court's refraining from addressing the agency relationship between the respondent and his principal and the appellant's contention that his authority did not permit him to institute the action, since this is the principal's concern and not hers.
Arabic original
Original Arabic judgment citations
