State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The insurer under compulsory motor accident insurance and the liable person. Their obligation in respect of the same debt despite its different sources. The effect thereof. Their concurrent liability in discharging it. Payment of the debt by the former is payment of the latter's debt, and the former is subrogated by operation of law to the injured person's rights against the liable person. - A solidary obligation has a single source, whereas a concurrent obligation has multiple sources despite the unity of its subject matter. The two types coincide as regards the effect of payment in terms of statutory subrogation. The reason therefor. - The insurer is a debtor vis-à-vis the insured or the injured person and a guarantor or surety vis-à-vis the liable person. The effect thereof. - 776 - Suretyship
