Kuwait Court of Cassation principle number 408

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The principle is that fruits belong to the owner or the person having the right to usufruct of the thing. The exception. The good-faith possessor's right to the fruits he receives and the benefit he obtains. The possessor is deemed to be in good faith until the contrary is established. He becomes a bad-faith possessor if an action is brought against him indicating that the right he claims over the thing he possesses does not belong to him. He is regarded as such from the time he is served with the statement of claim, even if he continues to believe that he holds a right. Example.
