Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 540

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The prohibition on claiming diyah for loss of life after receipt of the diyah due for loss of organs, senses, functions, or wounds has been established. Its condition. - The judgment’s rejection of the claim for diyah for loss of life because diyah amounts for disabilities and loss of functions had previously been received, without ascertaining the amount the injured party received for each diyah separately and whether their aggregate reached the prescribed limit for diyah for loss of life. Vitiates it by a deficiency that prevents the Court of Cassation from reviewing the proper application of the law, requiring its cassation.
