Kuwait Court of Cassation principle number 875

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Assessment of compensation redressing harm. Within the trial judge’s authority. The judge may award aggregate compensation for all harm. Its condition: specifying the elements of harm for which this compensation was awarded and discussing each element. Subject in this respect to review by the Court of Cassation. Its import. The judgment must state unambiguously what it awarded as diyah, arsh, or judicially assessed compensation and the amount of compensation for material and moral harm. An example concerning the appealed judgment’s failure to specify the amount awarded as diyah, arsh, or judicially assessed compensation, its failure to grant the injured party compensation for material and moral harm, and its allocation of the compensation amount without explaining the reasons, requiring its cassation.
