Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 883

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Assessment of compensation making good both material and moral damage. A matter of fact. Its limit: provided that the court sets out its constituent elements. The court's statement of the reasons that led it to assess compensation at the amount it considered sufficient to make good the damage. Not necessary. - The Court of Appeal has full jurisdiction to reconsider the action within the scope of the appeal. It may take an approach to assessing compensation differing from that of the court of first instance. It suffices that its view is sound and that its judgment rests on an acceptable basis. Factual argument. Impermissible before the Court of Cassation.
