Assessment of compensation is within the authority of the trial court - The Court of Appeal. Its task is not confined to reviewing the appealed judgment. The dispute is considered submitted to it for fresh determination; it may assess compensation differently from the court of first instance and is not required to adopt the latter's assessment. What suffices in this regard.

تقدير التعويض من سلطة محكمة الموضوع - محكمة الاستئناف. مهمتها لا تقتصر على محاكمة الحكم المستأنف. اعتبار النزاع مطروحاً عليها لتفصل فيه من جديد لها أن تذهب في تقدير التعويض بما يخالف محكمة أول درجة وليس عليها أن تعتمد تقدير الأخيرة. ما يكفي في ذلك.Original Arabic judgment citations
