Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1187

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The General Fire Department. It has no independent legal personality but is subject to the supervision of the Head of the Municipality. - Independent legal personality is acquired only by law. Reason for this. - The Head of Kuwait Municipality alone is the legal representative of the General Fire Department before the courts and all other entities. This is not altered by the fact that the conduct of cases brought by or against that Department is entrusted to the Department of Fatwa and Legislation rather than the Municipality's own Legal Department. Reason for this. - Joining the appellant as a party in the statement of claim without specifying his capacity. His capacity appearing in more than one place in the statement. Sufficient for the validity of joining him in that capacity. - 598 - Civil Procedure
