The Department of Fatwa and Legislation is the body entrusted with examining a grievance against an administrative decision, expressing an opinion on it and monitoring the progress of the administrative action concerning it. - Statements of claim in administrative actions are served at the headquarters of the Department of Fatwa and Legislation, which is entrusted with appearing - 604 - Civil Procedure on behalf of the Government to defend it and signing the statements of claim in those actions and appeals brought against judgments issued therein. The provisions governing this matter must be followed to the exclusion of any other prior provisions, which are deemed repealed by those new provisions. Basis thereof. - The existence of special legislation. Effect thereof. Recourse is not had to the provisions of the general law or any other law except in matters omitted by the special law. Reason for this. - Signature of a cassation appeal petition against a judgment issued in an administrative action by a lawyer in Kuwait Municipality's Legal Department rather than a member of the Department of Fatwa and Legislation. Effect thereof. Invalidity of the petition.
